Exemption rules
Alpha21, LLC (TabPhone) is exempt from the STIR/SHAKEN implementation requirements of 47 CFR § 64.6301 because it lacks control over the network infrastructure necessary to implement STIR/SHAKEN. The Commission has held that its caller ID authentication rules do not apply to providers that lack control of the network infrastructure necessary to implement STIR/SHAKEN (First Caller ID Authentication Report and Order, FCC 20-42, 35 FCC Rcd 3241, 3260, para. 40 (2020)), and reaffirmed that exemption, as applied to resellers, in the Eighth Caller ID Authentication Report and Order (FCC 24-120, paras. 8 and 17). TabPhone is a non-facilities-based reseller of interconnected VoIP service with no network of its own. Its wholesale provider, 9171-5573 Québec Inc., doing business as VoIP.ms, manages the voice service and handles its core functions, including switching and interconnection: VoIP.ms originates and terminates all of TabPhone's customers' calls to and from the public telephone network over its own network, holds the telephone numbers assigned to TabPhone's customers, and authenticates TabPhone's customers' outbound calls with STIR/SHAKEN using its own certificate, as the originating provider for its reseller customer. TabPhone's software connects its customers' apps to VoIP.ms and does not carry calls on the telephone network itself. TabPhone has no Operating Company Number. Every call TabPhone's customers originate is subject to the robocall mitigation program described in this filing. That includes vetting new customers, an acceptable-use policy that prohibits robocalls, bulk calling and caller ID spoofing, limits on call and text volume, suspension of offending accounts, and responding fully to traceback requests within 24 hours.
