- US Direct Telecom, FRN 0038909651, located at 8735 Dunwoody Place, Suite 400, Atlanta, Georgia 30350, is asserting the lack-of-control basis under 47 C.F.R. § 64.6305(d)(2)(i). US Direct Telecom does not own or control the underlying originating network, SIP switching infrastructure, carrier interconnection facilities, STIR/SHAKEN signing platform, or Service Provider Code token necessary to independently authenticate caller-ID information. The network facilities and caller-authentication functions are controlled by the underlying facilities-based upstream carrier or carriers. US Direct Telecom’s role is limited to obtaining and reselling authorized telecommunications services, administering customer accounts, applying customer-use requirements, monitoring traffic available to it, and cooperating with upstream providers and regulatory authorities. Because it does not control the network infrastructure necessary to implement STIR/SHAKEN, it cannot independently sign calls on that infrastructure. The upstream facilities-based provider is responsible for authentication functions occurring on the facilities under its control. This explanation applies only to US Direct Telecom’s inability to independently implement STIR/SHAKEN due to lack of control over the necessary network infrastructure. It does not exempt US Direct Telecom from maintaining an accurate Robocall Mitigation Database filing, operating a reasonable robocall mitigation program, knowing its customers and upstream providers, preventing illegal robocalls and spoofing, maintaining appropriate records, or responding fully and promptly to traceback requests. US Direct Telecom requires customers to provide accurate business and contact information, lawful traffic-use information, and authorization for caller-ID numbers and calling campaigns. The company may investigate, restrict, suspend, block, or terminate traffic associated with suspected fraud, unlawful robocalls, spoofing, misleading caller ID, unverifiable customer information, or failure to cooperate with traceback investigations.
