Pursuant to 47 C.F.R. § 64.6301(a), as interpreted by the FCC in the First Caller ID Authentication Report and Order, FCC 20-42, paragraph 40, the STIR/SHAKEN implementation requirement does not apply to providers that lack control of the network infrastructure necessary to implement STIR/SHAKEN. Sameday AI Inc. is a non-facilities-based reseller. It does not own, lease, operate, or control the switches, session border controllers, SIP infrastructure, or other voice-network facilities used to originate and exchange calls. Sameday does not have its own SPC token or STI certificate. Calls are delivered through Telnyx LLC, which controls the underlying network and authenticates the calls. Accordingly, Sameday lacks control of the infrastructure necessary to implement STIR/SHAKEN and qualifies for the non-facilities-based provider implementation exemption.
