Exemption rules
47 CFR § 64.6301(a) requires STIR/SHAKEN implementation only for voice service providers that originate SIP calls which traverse their own network and are authenticated with STIR/SHAKEN before reaching the interconnecting carrier. Because my service does not operate its own facilities-based network and does not directly interconnect with the public switched telephone network (PSTN), I am exempt from the STIR/SHAKEN implementation requirement. All outbound PSTN calls from my service are handed to my upstream carrier, which performs the STIR/SHAKEN authentication and signing. My platform itself does not originate SIP calls onto the PSTN over its own facilities, nor does it have the ability to sign calls using STIR/SHAKEN certificates. Therefore, I qualify as a non-facilities-based VoIP provider without a STIR/SHAKEN obligation under FCC rules.
