- Applicable Rule Exemption: Sandoval Health & Wellness LLC qualifies for the exemption under 47 CFR § 64.6304(a), which exempts voice service providers that do not have the technical ability to implement STIR/SHAKEN on the IP portions of their network and instead rely on an upstream carrier to perform call authentication. Explanation of Why This Exemption Applies: Sandoval Health & Wellness LLC does not own or operate the underlying switching, SIP proxy, softswitch, or IP Multimedia Subsystem (IMS) infrastructure required to perform STIR/SHAKEN call authentication. All outbound calls originated by the filer are delivered to upstream interconnected wholesale carriers who apply STIR/SHAKEN attestation on behalf of the filer. As a result, the filer has no direct access to the SIP headers where SHAKEN Identity tokens are created or inserted, and therefore cannot independently implement full STIR/SHAKEN functionality. Instead, the filer meets its obligations by: 1. Using fully STIR/SHAKEN-enabled upstream carriers who authenticate all outbound calls before they reach the PSTN. 2. Maintaining a comprehensive robocall mitigation program consistent with 47 CFR § 64.6305(a), including KYC onboarding, traffic monitoring, traceback cooperation, fraud detection, and proactive blocking of unlawful calling patterns. 3. Ensuring all traffic originated by its customers is screened, monitored, and compliant with federal robocall laws and Do-Not-Call requirements. For these reasons, Sandoval Health & Wellness LLC meets the criteria for exemption under 47 CFR § 64.6304(a), as it lacks the technical capability to perform call authentication directly and depends fully on certified upstream carriers to provide STIR/SHAKEN signing.
