Exemption rules: Smarteletec S.L. (d/b/a Numero eSIM) qualifies for the exemption from the STIR/SHAKEN implementation requirement because it is a foreign voice service provider. The company is incorporated and headquartered outside of the United States (Ceuta, Spain) and does not operate any facilities-based voice network within the U.S. PSTN. As such, under 47 CFR § 64.6304, Smarteletec is not obligated to implement STIR/SHAKEN. Instead, consistent with 47 CFR § 64.6305, Smarteletec maintains a Robocall Mitigation Program that includes: • Conducting due diligence to vet and validate customers before providing service, • Monitoring outbound traffic to detect patterns indicative of illegal robocalls, • Cooperating fully with traceback requests within 24 hours, and • Taking prompt remedial action to prevent its network from being used to transmit unlawful robocall traffic. This exemption applies because Smarteletec, as a foreign provider, cannot directly deploy STIR/SHAKEN on the U.S. PSTN, but complies with the FCC’s requirement to file, update, and maintain a Robocall Mitigation Plan in the Robocall Mitigation Database.
