- Rule / Basis: 47 CFR § 64.6305(d)(2)(i) (lack of control over the network infrastructure necessary to implement STIR/SHAKEN). The FCC has also stated that providers that lack control over the network infrastructure necessary to implement STIR/SHAKEN are exempt from implementing STIR/SHAKEN. Why it applies to Polarstar LLC (DBA Touchpoints): Touchpoints does not operate the voice network infrastructure used to originate, carry, or terminate SIP calls and therefore does not have the technical ability to implement STIR/SHAKEN signing/verification. Specifically: • Touchpoints does not generate outbound voice calls and does not originate call traffic. • Touchpoints receives inbound-call notifications from an underlying voice service provider and provides out-of-band routing instructions (e.g., forward-to destination number or terminate). • Touchpoints does not control SIP trunks, SBCs, softswitches, or other call-session infrastructure where STIR/SHAKEN Identity headers would be added, signed, or verified. • Because Touchpoints is not in possession or control of the call-path infrastructure, Touchpoints cannot implement STIR/SHAKEN directly; the underlying voice service provider that controls the SIP call path is the entity capable of implementing STIR/SHAKEN on applicable traffic. Accordingly, Touchpoints is unable to implement STIR/SHAKEN due to lack of control over the network infrastructure necessary to implement it. STIR/SHAKEN obligations attach to voice service providers for SIP calls they originate/terminate. Touchpoints does not control the SIP call path and therefore cannot perform the authentication/verification functions described in 47 CFR § 64.6301.
