- Following the February 26, 2024 effective date of the amended RMD requirements, the Wireline Competition Bureau (WCB) of the Federal Communications Commission (FCC) conducted a review of certifications in the RMD and identified providers that failed to update their RMD certifications and robocall mitigation plans with the required information by the deadline. WCB notified Hammer Technologies, Inc. (formerly Empirix) on March 29, 2024 that its certification was not compliant with the FCC’s rules because Hammer Technologies had failed to submit an updated RMD certification and updated robocall mitigation plan by the February 26, 2024 deadline. WCB’s notification informed Hammer Technologies that it must correct its RMD filings by April 29, 2024. After the expiration of this deadline, WCB referred Hammer Technologies to the Enforcement Bureau of the FCC to initiate removal proceedings. On December 10, 2024, the Enforcement Bureau released a Show Cause Order, which required the identified companies (including Hammer Technologies) to cure the deficiencies in their RMD filings or inform the Enforcement Bureau why they should not be removed from the RMD. A summary of the Show Cause Order was published in the Federal Register on December 17, 2025; and the deadline to comply with the Show Cause Order was December 31, 2024. Hammer Technologies did not cure the deficiencies in its RMD filing by December 31, 2024 due to an inadvertent internal administrative error. On August 25, 2025, the Enforcement Bureau adopted an Order finding that Hammer Technologies had a deficient certification and mitigation program description and warranted removal. The August 25th Order removed Hammer Technologies’ certification from the RMD and instructed all intermediate providers and voice service providers to cease accepting traffic from Hammer Technologies within two business days of the release date of the Order. Hammer Technologies filed its updated RMD certification and mitigation plan in the RMD on September 2, 2025, after receiving permission from WCB and the Enforcement Bureau to do so. The Enforcement Bureau notified Hammer Technologies on September 2, 2025 that Hammer Technologies had been provisionally reinstated to the RMD, pending the Enforcement Bureau’s final determination that Hammer Technologies’ RMD filing is compliant with the FCC’s rules.
